Curious Caterpillars - Terms & Conditions

1. Introduction

These Terms of Service and End User License Agreement ("Terms") govern your use of the Curious Caterpillars mobile application ("App"). The App is designed for children aged 5 to 13 years old. By accessing, downloading, installing, or using the App, you agree to be bound by these Terms.

2. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information, the legal basis for processing, and your rights under applicable data protection laws, including GDPR.

3. License Grant

FutureForce.ai hereby grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App on compatible iOS and Android devices that you own or control, subject to the terms and conditions of these Terms.

4. Restrictions on Use

You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof. Violating the terms of these Terms may result in account termination.

5. User Accounts

To access certain features of the App, you must register for a user account. You agree to provide accurate and complete information and to keep your account information up to date.

6. Parental Consent

By creating an account and using the App, you represent that you are the parent or legal guardian of the child using the App, and you consent to the collection and use of your child's information in accordance with our Privacy Policy.

7. Subscription Plans and In-App Purchases

The App offers subscription plans with a 14-day free trial limited to 100 messages. By subscribing to a plan, you agree to the associated fees and terms. All in-app purchases and subscriptions are subject to the respective platform's terms and conditions. To cancel subscriptions on iOS, go to Settings > [Your Name] > iTunes & App Store, tap your Apple ID, tap View Apple ID, sign in if requested, scroll down to Subscriptions, and tap the subscription you want to manage. To cancel subscriptions on Android, open the Google Play Store, tap Menu > Subscriptions, select the subscription you want to cancel, and tap Cancel subscription.

8. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, and software, are the property of FutureForce.ai or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9. Third-Party Services

The App uses Firebase for authentication and OpenAI for backend processing of data. By using the App, you agree to their respective terms of service and privacy policies.

10. Reporting Inappropriate Content or Behavior

Users can report any inappropriate content or behavior within the app by emailing [email protected].

11. Data Retention, Deletion, and User Rights

User data is retained indefinitely and used to improve the product or service. Users can request data deletion, access, rectification, restriction of processing, and data portability at any time by revoking parent consent within the app or contacting us at [email protected].

13. International Data Transfers

When processing personal data outside the European Union, we ensure an adequate level of protection for the data by implementing appropriate safeguards as required by GDPR. These safeguards may include standard contractual clauses, Privacy Shield certification, or other legally recognized mechanisms.

14. Termination

This EULA is effective until terminated by you or FutureForce.ai. Your rights under this EULA will terminate automatically without notice if you fail to comply with any terms of these Terms. To terminate your account or request data deletion, you can revoke parent consent within the app, and your account will be terminated accordingly.

15. Warranty Disclaimer

The App is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. FutureForce.ai does not warrant that the use of the App will be uninterrupted or error-free or that defects will be corrected.

16. Limitation of Liability

In no event shall FutureForce.ai or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or any breach of these Terms.

17. Dispute Resolution

Any dispute arising from or relating to these Terms will be resolved by binding arbitration administered by a single arbitrator under the rules of a recognized arbitration institution in the country where FutureForce.ai is incorporated. The arbitration will be conducted in the English language. The award rendered by the arbitrator will be final and binding upon the parties, and judgment upon the award may be entered in any court having jurisdiction. The parties waive any right to a trial by jury and agree not to participate in any class action lawsuits.

18. Governing Law

These Terms will be governed by and construed in accordance with the laws of the country in which FutureForce.ai is incorporated, without regard to its conflict of laws provisions.

19. Amendments

FutureForce.ai reserves the right to modify or amend these Terms at any time. Your continued use of the App constitutes your acceptance of any changes.
